Terms and conditions of sale

Last updated: [date]

These terms apply to the programmes sold by [Company name] (“The Amour Club”, “we”) under the names L'Expérience and L'Expérience Privée. Together with the programme proposal you receive, they form the written contract between us.

1. What we offer

L'Expérience is a 5-day programme in Paris, in a small group of no more than 6 participants: hosted moments with French gentlemen (welcome cocktail, dinners, lunches, a bike ride, a wine-tasting soirée, a cruise on the Seine, a supper club), introductions chosen for you, and dates arranged whenever two people wish to meet again. L'Expérience Privée is a programme of the same length, arranged for you alone, on dates chosen with you, with one-to-one introductions.

The programme, the hosted moments and the services included are described on our website and in the programme proposal. All services are provided in English.

2. What we do not sell

We sell no accommodation, no transport and no other travel service. You book and pay for your own flight, hotel, travel and insurance, with the providers of your choice. We may recommend places to you; these recommendations are free, without obligation and without any commission for us, and the contracts you make with those providers do not bind us.

[For the lawyer to confirm: that this model places the activity outside articles L.211-1 et seq. of the French Tourism Code (no sale of package travel or travel services), including for the Seine cruise and the bike ride.]

3. Booking

You send us a request through the form on our website. We arrange a short call to get to know you. If we both wish to go ahead, we send you, on a durable medium, a programme proposal and this contract. The contract is concluded when you have signed it.

The contract ends when the programme ends. Its duration can never exceed one year. [For the lawyer to confirm: whether article 6 of French law no. 89-421 of 23 June 1989 applies (offer of introductions with a view to marriage or a stable relationship) and, if so, the list of mandatory terms the contract must contain.]

4. Price

L'Expérience: €7,500 per participant. L'Expérience Privée: €14,000. Prices include all taxes. They cover the hosted moments described for the chosen programme (meals, drinks and activities, champagne included), the introductions, the arranging of dates and the support of your concierge.

They do not include your travel to Paris or within Paris outside the planned activities, your accommodation, your insurance, your visa fees, your personal expenses, or the cost of any dates you choose to have outside the hosted moments.

Prices are fixed: they will not be increased after the contract is signed.

5. Withdrawal period

You have 7 days from signing the contract to withdraw from it, without giving any reason and at no cost, by letting us know on a durable medium (email or letter). We receive no payment before this period has ended.

[For the lawyer to confirm: the legal basis of this period (article 6 of law no. 89-421 if it applies; otherwise a period granted by contract, since the 14-day withdrawal right for distance contracts may be excluded for leisure activities provided on a set date, article L.221-28, 12° of the French Consumer Code) and whether the ban on payment during the period is accurate.]

6. Payment

Once the withdrawal period has ended, a deposit of 30% of the price is payable to confirm your place. The balance is due no later than 60 days before the programme begins. If the contract is signed less than 60 days before the programme begins, the full price is payable when the withdrawal period ends. Accepted payment methods: [to be completed].

If the balance is not paid on time, and a reminder remains unanswered, we may treat your participation as cancelled; the fees in section 7 then apply.

7. If you cancel

After the withdrawal period, you may cancel your participation at any time before the programme begins, by letting us know on a durable medium. Cancellation fees then apply, based on the date we receive your notice:

These fees reflect the bookings we make for you (tables, venues, activities, hosts) and the place we can no longer offer to someone else. [For the lawyer to confirm: that this scale is proportionate under the rules on unfair terms.]

Your flight and hotel are your own contracts: whether you can cancel them depends on those providers' conditions. We strongly recommend insurance covering the cancellation of your trip.

8. Changes and cancellation by The Amour Club

We may replace a restaurant, venue or activity with one of equivalent quality, telling you clearly and without delay. If an essential element of the programme cannot go ahead, you may accept the change we propose, or cancel your participation and receive a full refund.

If we have to cancel the programme, in particular because of force majeure, we refund everything you have paid us. Group programmes go ahead whatever the number of participants booked. We do not refund travel and accommodation costs you have paid to third parties, unless the cancellation is our fault. [For the lawyer to confirm.]

9. During the programme

Your concierge is your point of contact throughout the programme, reachable [24/7] on [telephone number] and at [email address]. Every moment and every meeting is optional. If something does not match what was planned, tell us straight away so that we can put it right.

You are responsible for your travel documents (passport, and a visa if you need one). Once your participation is confirmed, we can give you a letter describing your programme in Paris.

10. Our promise, and its limits

We promise an exceptional week in Paris. We do not and cannot promise a romantic outcome: meeting someone is a possibility, never a service owed. The gentlemen, like you, are free in their choices. No refund is due because a meeting did not lead to a relationship.

11. Code of conduct

Every participant and every gentleman accepts our code of conduct. It is what makes our moments safe and sincere.

A serious breach of the code (in particular harassment, threatening behaviour, or asking for or offering money) may lead to immediate exclusion from the hosted moments, with no refund for unused services. [For the lawyer to confirm: that this sanction is proportionate under the rules on unfair terms.] You may raise any concern with your host or concierge at any time.

12. Liability and insurance

We are responsible for the proper performance of the services included in your programme, whether we provide them ourselves or through the establishments we choose (restaurants, venues, activity providers). We are not responsible for services you buy directly from third parties, even when we recommended them.

The Amour Club holds professional liability insurance with [name and address of the insurer]. [For the lawyer to confirm: the wording of this clause under the rules on unfair terms (no limitation of the compensation owed to a consumer).]

13. Personal data

How we handle your personal data is explained in our privacy policy.

14. Complaints and mediation

Please send any complaint to [contact email address]. We reply as quickly as possible. If you have not received a satisfactory answer, you may refer the matter free of charge to the consumer mediator [name and contact details of the mediator we belong to], as provided by article L.612-1 of the French Consumer Code.

15. Applicable law and language

These terms are governed by French law, without prejudice to any more protective mandatory rules of the law of the participant's country of habitual residence [lawyer to confirm]. They are available in several languages; in case of any difference, the French version prevails.
